These terms of use constitute a contract between you and VirtuWeave. Before using the product (as defined below) or any of its updates, you must carefully read and agree to these terms. By using any part of the product, you agree to these terms. If you do not agree, you may not use the product, in whole or in part.

License Agreement

Your use of this product is subject to this license agreement (hereinafter “Agreement”) and the terms set forth in the latest version at any given time. For the purposes of this Agreement, all references to the “Product” include the Places VR: The Statue of Liberty application and its copies, its data files and related software, packaging and media materials, documentation, instructions, and license agreements, including any updates to the main application and any related materials. By installing and/or opening the product and using it or any related software and materials, you accept the terms of this Agreement with VirtuWeave. (hereinafter “Licensor”).

This license agreement may be updated from time to time, and the latest version can be found at https://virtuweave.com/terms-of-use. Using this product indicates your acceptance of the latest terms. The user is obligated to check this document to stay informed of the latest changes. Minors must ensure that their parents and/or legal guardians read and accept this Agreement and the accompanying privacy policy on their behalf before using the product. Children under the age of 13 are prohibited from using this product, in whole or in part.

Commercial Use

COMMERCIAL USE IS STRICTLY PROHIBITED WITHOUT THE EXPRESS PERMISSION OF THE LICENSOR.

Licensing and Intellectual Property Rights

Under this Agreement and its terms, the Licensor grants you a non-transferable, non-licensable, non-exclusive license to download, install, and use one copy of the product for personal, non-commercial use in private residence, specifically for gaming purposes. By installing and using the product, you agree to the terms of this license, which begins on the date of installation or use of the product and ends upon deletion of the product or other termination by the Licensor. Your license terminates immediately upon violation of any terms of this Agreement.

The product is licensed to you, and you acknowledge that no title or ownership rights to the product are transferred, and this Agreement should not be construed as a sale or transfer of any rights to the product. All rights remain with the Licensor and Licensors. The Licensor retains all rights and interests to the product, including but not limited to all copyrights, trademarks, titles, visual effects, stories, dialogues, artworks, and all other intellectual property rights. The product may not be reproduced, copied, or distributed in any form, in whole or in part, without prior written permission from the Licensor. Any person or entity copying, reproducing, or distributing any part of the product violates copyright laws and the terms of this Agreement and may be subject to criminal liability.

The product is intended for private, home, and non-commercial use only. You agree not to use this product outside of private residence and acknowledge that commercial use is strictly prohibited without the explicit written permission of the Licensor.

Restrictions

You may not circumvent or attempt to circumvent any content protection system or digital rights management (DRM) software or any other security technology related to the product. You may not attempt to edit, modify, translate, reproduce, decompile, reverse engineer, or create derivative works based on the product or any related materials, in whole or in part. You may not resell, rent, copy, distribute, or otherwise duplicate the product or related materials. The product may not be shown, exhibited, or demonstrated publicly or in public places, in whole or in part, without the explicit written permission of the Licensor.

Collection and Use of Information

We currently do not collect any personal data, and voice interaction takes place locally on your devices. We reserve the right to do so in the future to improve our products, in which case we will notify users from within the product and update this license agreement and privacy policy to reflect such data collection. We do not store, sell, or transfer any personal information.

Disclaimer of Warranties and Limitation of Liability

The product is provided “AS IS” without any warranties of any kind. To the maximum extent permitted by law, VirtuWeave, its affiliates, licensors, agents, and service providers disclaim all warranties and conditions, express or implied, including but not limited to fitness for a particular purpose, completeness, security, compatibility, functionality, quality, and equivalence under the laws of any jurisdiction.

THE LICENSOR, THE LICENSOR’S SERVICE PROVIDERS, AND ANY PERSON OR ENTITY INVOLVED IN THE DEVELOPMENT, PRODUCTION, OR DISTRIBUTION OF ANY SERVICES OR CONTENT OF THE PRODUCT, INCLUDING THEIR DIRECTORS, EMPLOYEES, OR AGENTS (COLLECTIVELY “LICENSOR PARTIES”) MAKE NO WARRANTIES REGARDING THE USE OF THE PRODUCT.

IN NO EVENT SHALL THE LICENSOR OR LICENSOR PARTIES BE LIABLE FOR ANY DAMAGES OR PERSONAL INJURIES RESULTING FROM THE OWNERSHIP, USE, OR MALFUNCTION OF THE PRODUCT. THE LICENSOR AND LICENSOR PARTIES SHALL NOT BE LIABLE FOR LOSS OF PROPERTY, ACCIDENTS, HARDWARE OR SOFTWARE MALFUNCTIONS, OR ERRORS. TO THE EXTENT PERMITTED BY LAW, THE LICENSOR AND LICENSOR PARTIES SHALL NOT BE LIABLE FOR PERSONAL INJURY OR DEATH RELATED TO THE USE OF THE PRODUCT OR ANY OF ITS MATERIALS. YOU ACKNOWLEDGE THAT THE USE OF VIRTUAL REALITY MAY AFFECT HEALTH, INCLUDING BUT NOT LIMITED TO REPETITIVE MOTION INJURIES, EYE STRAIN, SKIN IRRITATION, HEADACHES, MIGRAINES, EAR PAIN, MOTION SICKNESS, EMOTIONAL STRESS, AND RELATED EFFECTS. THE LICENSOR RECOMMENDS FOLLOWING ALL SAFETY AND HEALTH GUIDELINES PROVIDED BY THE MANUFACTURERS OF HARDWARE AND SOFTWARE AND IS NOT LIABLE FOR ANY HEALTH EFFECTS RESULTING FROM THE USE OF VIRTUAL REALITY OR THE PRODUCT.

You also acknowledge and agree that the Licensor Parties do not warrant that the product will meet your requirements, be compatible with your hardware, or operate error-free with your specific hardware. You acknowledge and agree to follow the safety instructions and procedures as outlined in the end-user license agreement provided with your virtual reality hardware and related devices required to run and use the product.

Miscellaneous

This Agreement constitutes the entire agreement between the Licensor and you governing your use of the product, superseding any prior agreements. This Agreement is governed by the laws of Poland, without regard to conflict of law principles. Any dispute arising from this Agreement is subject to the jurisdiction of the courts of Warsaw, Poland. This Agreement may be updated from time to time, and the latest version can be found at https://virtuweave.com/terms-of-use. The latest version of this Agreement applies to your version of the product and supersedes any prior agreement or absence of agreement regarding the use of the product, as permitted by law. It is your responsibility to ensure that you and anyone using your copy of the product have read and agreed to the terms of this Agreement. If any part of this Agreement becomes invalid or unenforceable, that part shall be construed as closely as possible to the original intentions of the parties, and the remaining provisions remain in full force. The Licensor’s failure to enforce any part or provision of this Agreement shall not be considered a waiver of such parts or any other provision of the Agreement.
